It is a condition of use that any individual or corporation subscribing to or using any of the services provided by NetPost agree to abide by all the Terms and Conditions of Use as set out below. As a corporation or an individual, you agree that the following Terms and Conditions of Use constitute the entire agreement between you and NetPost in respect of your access to and use of the services and information provided by NetPost. There are no variations to these terms.

1. The information provided on the NetPost website is for the residents of Australia only and should not be relied upon by other corporations or individuals from any other jurisdiction.
2. NetPost employs ‘zero tolerance’ towards the sending of unsolicited emails or ‘Spam’. There are severe penalties applicable under Australian law for anyone sending such unsolicited emails. NetPost will immediately terminate the subscription of any individual or corporation found to be using our subscriber services for such purpose. As a result of such termination, the individual or the corporation will forfeit any right to a full or partial refund of any monies paid to NetPost.
3. You hereby agree that you will not transmit, upload or post to or from the NetPost website any defamatory, pornographic or obscene material or any other material that would violate any law. NetPost will accept no liability or responsibility for the content or publication of any such material from any individual or corporate customers of NetPost. Any such publication shall be entirely your liability.
4. You hereby agree that NetPost may use the information you provide to send you information about our services or products unless you have informed us that you do not wish to receive such information.
5. You hereby warrant that any information that you provide to NetPost will be accurate, whole, complete and true.
6. You hereby warrant that you will not use or publish any information or newsletter using the services provided through NetPost for any unlawful or illegal purpose or any such use that may be in breach of these terms and conditions of use.
7. All material including the software and the design, layout, text, graphics or code contained or in use or used to produce the NetPost site and templates is subject to copyright. Your use of our site is governed by both the terms and conditions as set out herein and our copyright is governed by the copyright laws of Australia.
8. Any passwords provided by NetPost to you for access to our subscriber services are to be kept secure by you and are only to be used for the purposes for which they were provided. You hereby agree to indemnify NetPost against any and all losses or damages resulting from any unauthorized use of your password(s).
9. You hereby agree that you will be solely responsible for your use of NetPost subscriber services and that the content that you may post or send as a result of our services is your creation alone. You also hereby agree to indemnify and keep indemnified NetPost from any claim, suit, loss or damage or demand from the posting of such content or through the use of our subscriber services.
10. NetPost reserves the right to cancel the subscription of any individual or corporate subscriber who breaches the terms and conditions of use as set out herein or who otherwise causes or in our opinion is likely to cause, loss damage or detriment to NetPost, its subscribers or any other associates. Any such termination resulting under this clause will cause a loss to the subscriber of any monies or fees paid to NetPost and no refund or partial refund will apply to the cancellation of our services. NetPost hereby prohibits the copying, publishing, distribution or creation of any other form of material or work from this website or subscriber services for any other purposes than intended. Any individual or corporate subscriber must satisfy themselves that any information and material provided on the NetPost website or by NetPost is sufficient and relevant for its intended purposes. NetPost does not warrant the accuracy or currency of any information or material provided.
11. There may at times be temporary disruption to our subscribers as a result of events outside of the control of NetPost or occasionally as NetPost seeks to amend its website information or material. NetPost agrees to use its best endeavours to keep any disruption to a minimum. You hereby agree to hold NetPost harmless for the disruption of such services or for the loss of any data whether or not such loss or disruption is as a result of the negligence of NetPost, its servants, contractors or agents.
12. To the extent permitted by law, NetPost hereby disclaims all and any responsibility for any direct or indirect loss or damage of any kind that any person or corporation may suffer from the reliance of information and material on our NetPost website whether or not such loss or damage is caused by any fault or negligence on the part of NetPost, its officers, agents, employees or associates (and specifically including the loss of use, data or profits or delays or loss of business).
13. Linking to the NetPost website is expressly prohibited without prior written consent from NetPost.
14. NetPost will not be liable for any damage or loss resulting from any cause of disruption to your computer system or website or to any third party individuals or corporations linking to our website through you or accessing NetPost material uploaded by you or caused in any way whether directly or indirectly by or in connection with the use of or access to our NetPost website. Any such loss or damage will be your sole responsibility.
15. You hereby agree that you will take your own precautions in relation to protecting your computer system or website from malfunction, viruses or spam and you hereby agree that you will take every reasonable precaution to ensure that no virus or spam is sent to our website. NetPost will use its best endeavours to ensure that any service we provide is accurate, timely and secure but NetPost does not make any warranty or assurance in this regard. NetPost also makes no representation or warranty that any service provided by NetPost is suitable for your intended purpose or that it will meet your expectations.
16. All fees and subscription services are to be paid one month in advance. All template costs are to be paid in advance prior to issue and use. All charges will be billed and collected by way of credit card payment prior to the use of any individual or corporate usage of the NetPost services.
17. Any individual or corporate information posted or uploaded to NetPost with the exception of any credit card details or personal information will be deemed not to be confidential by NetPost. You hereby grant NetPost an unrestricted irrevocable and non-exclusive license to use, display, reproduce, modify, transmit or distribute any such information, techniques or concepts that you post or upload to NetPost for any commercial and non-commercial purposes including but not limited to advertising and promotional purposes.
18. Should any of these terms outlined herein be held to be invalid or unenforceable by a court of law, such term or provision shall be severed from these terms and conditions of use and the remaining terms and provisions shall remain in full force and effect.
19. Any failure to act with respect to a breach by you of these terms or conditions or by others of these terms or conditions does not waive NetPost's right to take action against you with respect to subsequent or similar breaches.
20. The terms and conditions of use as set out herein are governed by and construed in accordance with the laws of the State of Queensland and you hereby consent to the exclusive jurisdiction of the Courts of that State (including any Courts having an appellate jurisdiction therefrom).
